Term of Service
This ToS applies to all personal commission services.
By commissioning me you are agreeing to the following terms.
GENERAL- This service is digital commission only. No physical copies of the artwork are included unless discussed otherwise.
- All communication will be conducted via email or discord. Please provide your preference in request form.
- I reserve the rights cancel the commission if the clients fail to response within 14 days in the commissioning process without prior notice.
- I reserve the right to decline your inquiry if I'm not interested in the inquiry, and/or feel uncomfortable, and/or believe that I'm unable to execute it well.If you're unsure if your commission could fall into these topics / subjects, do send the request to me and I can let you know.
A few topics / subjects I do not accept:- Explicit
- NSFW (suggestive theme or artistic - nudity is okay)
- Heavy Mecha
- Heavy Gores
- RealismPAYMENT- Payment is due in full upfront for any commission equal to or below $150 USD in total.
- For amounts greater than $150 USD in total, payment plans are available. These will depend on the price and your circumstances. You will receive the full resolution only after final payment is made.
- If payment is not received within 5 days without prior communication the commission will be canceled.
- An additional fee of 10% will be added to your total fee for sales tax.PROCESSMy process generally consists of 3 stages:
1. Research and draft: discussing any information of the character(s) or other written/visual contents to brainstorm some initial ideas for the commission. 2-3 draft options will be provided to the client.
2. Pre-render: drawing the overall composition and some key details. At the end of this step, the level of rendering will reach 40-50% completion.
3. Render and finalizeProcess Update:
- In the 2nd stage, I will update 2-4 times a month for any feedback and change.
- In the 3rd stage, I will update 1-2 times a month or when the artwork reach a major milestone.REVISIONSThe client is entitled to:- 2 major revisions during the 1st stage.
- 1 major revision and 2 minor revisions during the 2nd stage.
- 1 minor revisions during the 3rd stage.
*Any extra revisions will be charged with an additional cost.Note:- I will always confirm before continuing progress. Any take-backs after proceeding will be count as a major revision.
- Major revisions include but not limited to: poses, outfits, background etc.
- Minor revisions include but not limited to: small detail adjustments, color adjustments, etc.
- Anything I miss in your commission details or reference is not counted towards the revisions.
- Revisions may affect deadlines.
DEADLINES AND DELIVERY- Estimated turn-around time is 1-3 months after total or first invoice is paid. Any unexpected situation, delay in communication, and major revision might affect deadlines.
- The client may request a rush order for commission that needs to be completed under 4 weeks. Please write your desired deadline in the request form in the format mm/dd/yyyy. This will incur a rush fee +10-30% total commission fee depends on the deadline.
- I reserve the rights to decline any rush deadline I am unable to fulfill.INTELLECTUAL PROPERTY RIGHTSCommissions are for personal, non-commercial use only unless discussed otherwise. Please let me know if you intend to use the artwork for commercial use (e.g. merch printing, stream assets, publishing) as that will incur a higher fee.- I reserve the copyright as well as the right to use the final artwork for promotional purposes (portfolio, social media). The client is to be credited in my post. If the client wish to request a private commission, an NDA fee of 80% from the original price will incur.
- I reserve the right to reuse sketches and design elements that are rejected by the client for other commissions or personal works. This does not include the character design owned by the client or other Intellectual Properties.
- I reserve some commercial rights with limitations:
--- I may stream or showcase the commission process on any livestream or social media platforms. (unless you request me not to)
--- I may not share the full-sized final artwork or full-sized working files with unauthorized parties.
--- I may not use the commission for direct sale without permission from the client, such uses include but are not limited to: commercial artbook, commercial prints and merchandises, selling with print on demand services, reselling.USE- Upon receipt of the final artwork, the client is authorized to make use of the artwork for any personal, non-commercial purposes.
- Sharing/uploading the artwork on the Internet will requires my credit name (diowowowo / diow7), preferably with a link to one of my social media.
- The client may not use the artwork for Generative AI training or machine learning in any form.
- The client may not modify or alter the artwork in any way, nor reach out to another artist to do so. This includes the any sketch option that the artist offers during creation of the artwork.
- The client may not resell the artwork without my direct permission. This includes sales as NFTs.REFUND- The client may request a full refund if commission has not been started.
- If the client wishes to cancel their commission during the drafting stage, they will be refunded 50% of what they have paid.
- If the client wishes to cancel their commission during the pre-render stage, there will be no refund.
- In case unexpected situation comes up from my side, I will bring up discussion for refunds and/or other means of compensation.
- If I become unable to fulfill commission for any unjustifiable reason, the client will receive a full refund.
- Please consult with me before filing a chargeback.
Commission process:
1. Gather your idea and references (Please gather all of your image references in a google drive folder)
2. Fill out the form above
3. Wait for a quote from me
4. Once you accept the quote, make payment (full upfront or according to your payment plan) so I can start working
5. Discuss and revise your commission as I update the progress
6. Make final payment (for payment plan)
7. Receive final artwork
